The activities falling within the EU ETS
The d. lgs . 30/2013 , which governs in Italy and reform the system of exchange of emission allowances pursuant to Directive 2009/29/EC , has redefined the activities subject to the system ( Annex I) which can be divided into two categories:
-activities carried out at fixed installations.
among these are: activities involving emission of CO2 alone , even activities involving emissions of other greenhouse gases, activities related to the capture and geological storage of CO2
Relevant is the exception in Article . 2, paragraph 2 of the Decree on incineration of waste attributable to " Combustion of fuels in installations with a rated thermal input exceeding 20 MW " (Annex I ), but they dispose of more than 50 % by weight relative to the total waste treated in the following categories : municipal waste , hazardous waste , non-hazardous waste products from waste treatment plants , in turn, fed with municipal waste annually for a share of more than 50 % by weight.
It should be noted that this exclusion for the system operator determines ruled the obligation to report certifying compliance with the conditions for exclusion from reiterasi obligation during renewal AIA (IPPC ) .
Cases of exclusion include also in the aviation sector : State flights from non-EU countries , military flights , flights in sight, flights aircraft weighing less than 5.7 tons at take-off and others.
Compared to the task is even more relevant signal the possibility of entry into the EU ETS , at the request of the operator or on the initiative of the Committee of activity and greenhouse gases not listed in Annex I (Art. 37 ) and the possibility of exclusion, at the request of plants with lower pollutant load prior adoption of equivalent measures aimed at reducing emissions (Article 38) .
In particular, they may request exclusion :
- Plants which in 2008-2010 have resulted in lower emissions of CO2 equivalent tons 25000
- Thermal plants combustion of fuels with a rated thermal input below 35 MW , excluding emissions from biomass
- thermal plants subservient to hospitals.
